Terms of Service

1. Who you're contracting with

These Terms govern your use of Captioncraft (the "Service"), operated by Stancescu Marius, an individual sole trader trading as "Captioncraft" ("Captioncraft", "we", "us"). By creating an account or using the Service, you are entering into a binding agreement with Stancescu Marius.

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age in your jurisdiction and, if using the Service on behalf of an organisation, that you have authority to bind it.

3. The service

Captioncraft is a generative-AI tool that produces social-media captions and hashtag suggestions from prompts you submit. Outputs are suggestions only — you are responsible for reviewing, editing, and using them in compliance with the policies of any platform you post to.

4. Acceptable use & prohibited content

You must not use the Service to: (a) break any law; (b) generate or distribute content that is illegal, harassing, defamatory, sexual content involving minors, hateful, deceptive (including non-consensual deepfakes), or that promotes self-harm; (c) infringe anyone's intellectual property or privacy; (d) attempt to jailbreak, prompt-inject, reverse engineer, scrape, or probe the Service or its underlying models; (e) introduce malware or interfere with security; or (f) resell or redistribute the Service or its outputs at scale without our written consent.

5. Your content and responsibility for outputs

You retain ownership of the prompts you submit. You are responsible for ensuring you have the rights to any input you provide and for how you use any output, including verifying factual accuracy. Outputs from generative AI can be inaccurate, biased, or misleading and are not a substitute for professional advice. To the extent permitted by law, we assign to you any rights we may have in outputs generated specifically for you, subject to these Terms. We may take down or restrict content that violates these Terms and may terminate accounts that repeatedly infringe third-party rights.

6. Our intellectual property

The Service, including its software, design, branding, prompts, and documentation, is owned by Captioncraft or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose within your chosen plan. You may not copy, modify, distribute, sublicense, or create derivative works of the Service itself.

7. Accounts

You must provide accurate information and keep your account credentials confidential. You are responsible for activity under your account.

8. Payments, subscriptions, and billing

Paid plans (including the Pro plan described on our Pricing page) are billed in advance on a recurring basis (monthly or yearly, as selected at checkout) and renew automatically until cancelled. Prices are shown at checkout, exclusive of any applicable taxes which are added by our reseller. You can cancel at any time from your account; cancellation takes effect at the end of the current paid period, and you retain access to Pro features until then. Detailed payment, billing, tax, renewal, and cancellation mechanics are governed by Paddle's Checkout Buyer Terms (see clause 9 below).

9. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We offer a 30-day money-back guarantee on Pro subscriptions. See our Refund Policy for how to request a refund.

11. Suspension and termination

We may suspend or terminate your access (with or without notice as appropriate) for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we may retain data as described in our Privacy Policy.

12. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Captioncraft disclaims all implied warranties (including merchantability, fitness for purpose, and non-infringement) and makes no guarantee that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or suitable for any particular use. To the maximum extent permitted by law, Captioncraft's aggregate liability arising out of or related to the Service is limited to the fees you paid to us (via Paddle) in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

13. Indemnity

You will indemnify Captioncraft against claims arising from your inputs, your use of outputs, or your breach of these Terms.

14. Changes

We may update these Terms. Material changes will be notified by email or in-app. Continued use after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the seller's jurisdiction, without regard to conflict of law principles. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer law gives you the right to bring proceedings elsewhere.
